Acceptance of Terms

By accessing or using this website (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. These terms apply to all visitors, including those who download the Order of Operations physician guide.

About Brave New Media

Brave New Media is an independent brand and content agency. We provide social media strategy, content, and online-presence services to organizations across industries, with a focus on B2B operators in industrial and supply chain sectors. The Site is informational in nature and the guide is offered as a complimentary resource. Engagement of paid services is subject to a separate written agreement.

The Guide

The Order of Operations physician guide ("the Guide") is provided free of charge. Accessing or downloading it constitutes a request, not a contract. The Guide reflects industry research and methodology developed by Brave New Media at the time of publication and is provided "as-is." We reserve the right to update or retire the Guide at any time without notice.

Informational Purpose Only

The content on this Site, including the Guide, is provided for general informational purposes. Nothing on this Site or in the Guide constitutes legal, financial, investment, or other professional advice. Findings and recommendations in the Guide are based on the authors' research and experience. Decisions taken in reliance on the Guide are made at the reader's sole discretion and risk.

Intellectual Property

All content on this Site, including text, graphics, logos, design, and any unique methodology and frameworks, is the property of Brave New Media or its content suppliers and is protected by applicable copyright and trademark laws. The Guide is provided under a limited, non-transferable, non-exclusive license for your personal or internal business use. You may not reproduce, distribute, or create derivative works from the Guide or any content on this Site without our prior written consent.

User Submissions

When you provide information to access or download the Guide, you grant Brave New Media the right to use that information to deliver the Guide and communicate with you about it. You represent that any information you submit is accurate to the best of your knowledge.

Third-Party Links

This Site and the Guide may contain links to third-party websites. These links are provided for convenience only. Brave New Media has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

Disclaimer of Warranties

This Site and the Guide are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, Brave New Media and its principals, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of this Site or the Guide, even if advised of the possibility of such damages. Our total aggregate liability arising from or related to the Guide shall not exceed the amount you paid for it, namely zero.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

Dispute Resolution and Arbitration

We encourage you to contact us first if you have a concern at anne@brave-new.com. If a dispute cannot be resolved informally, both parties agree to resolve any claim, dispute, or controversy arising out of or relating to these Terms or the Site through binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that either party may bring qualifying claims in small claims court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. By agreeing to these Terms you are waiving your right to a trial by jury.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entire arbitration provision shall be null and void.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
